Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of https://www.bolunga.co.za (the "Site") operated by Bolunga Systems ("Bolunga", "we", "us"), Unit 5 Platinum Close, Tsessebe Crescent, Corporate South Park, Midrand, 1685, South Africa. By using the Site you accept these Terms. If you do not accept them, please do not use the Site.

Services purchased from Bolunga (consulting, engineering, software, connectivity, e-waste recovery and related work) are additionally governed by the signed agreement or statement of work for that engagement, which prevails over these Terms where they conflict.

2. Use of the Site

You may use the Site to learn about our services and to submit genuine enquiries. You may not: probe, scan or test its security without written permission; submit false, unlawful or malicious content through any form; attempt to disrupt the Site; or use automated systems to harvest content or submit spam.

The Bolunga AI assistant provides general information only. Its answers are not professional, legal, financial or technical advice and should be verified with a qualified person before you rely on them.

3. Quotations and contracts

Requests for quotes, consultations or reviews submitted through the Site are invitations to treat, not offers. A binding contract arises only when Bolunga issues a written quotation or agreement and you accept it in writing.

Prices, timelines and scopes in quotations are valid for the period stated in the quotation (default 30 days) and exclude VAT unless stated otherwise.

4. Intellectual property

All content on the Site — text, logos, brand marks, images, design and code — is owned by or licensed to Bolunga and protected by South African copyright and trademark law. You may view and print it for personal, non-commercial evaluation; you may not republish, sell or create derivative works from it without written permission.

Content you submit (enquiry text, documents you share with a project) remains yours; you grant Bolunga a limited licence to use it only to respond to and serve your enquiry.

5. Personal information

Our processing of personal information is described in the Privacy Policy, which forms part of these Terms. By using the Site you acknowledge that processing as described.

6. Availability and warranties

We aim for high availability but provide the Site "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

We may suspend, change or withdraw any part of the Site at any time without notice, including for maintenance or security reasons.

7. Limitation of liability

To the maximum extent permitted by South African law, Bolunga is not liable for indirect, incidental or consequential loss arising from your use of the Site, or for loss caused by events beyond our reasonable control.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

8. Third-party links

The Site may link to third-party sites and services (for example WhatsApp and social networks). They are governed by their own terms and privacy policies; we are not responsible for their content or conduct.

9. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The courts of Gauteng have jurisdiction over disputes, without prejudice to our right to seek urgent relief in any competent court.

If any provision is held unenforceable, the remainder continues in force.

10. Changes and contact

We may update these Terms; the version date below applies. Continued use after a change constitutes acceptance.
